This online trade contract is the one by which BLACK ORCHID offers the sale of jewelry at a distance and electronically as part of its economic activity.
These conditions of sale are concluded on the one hand by BLACK ORCHID called “the seller” and on the other hand, by any natural or legal person wishing to make a purchase via this site, hereinafter referred to as “the buyer. “.

These conditions of sale will prevail over all other general or special conditions not expressly approved by the seller. The seller reserves the right to be able to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

CHARACTERISTICS
The products offered for sale are those which appear in the merchant catalog published on the seller’s site BLACK ORCHID. These products being unique products or limited series, they are offered within the limits of available stocks. Each product is accompanied by a description established by the seller. The characteristics of each jewel are mentioned in the description sheet, the photographs in the catalog are as faithful as possible but cannot ensure a perfect similarity with the product offered

PRICES
The prices appearing in the catalog are net prices in euros, all taxes included. The sale made is invoiced including VAT. The seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. Shipping charges are the responsibility of the buyer. They include the shipping price (current rate of the Spanish Post), the packaging, as well as the logistics costs.

GEOGRAPHICAL ZONE
The online sale of the products presented on the site is reserved for buyers who reside in the European Union, Switzerland, South and North America, Australia. The countries of Asia, Africa and the Middle East are currently excluded. In the event of delivery outside the countries of the European Union, administrative and / or customs costs may be applied by the carrier and paid by the buyer.

ORDER
The buyer who wishes to buy a product must:
complete an identification form on which he will indicate all the requested contact details, deliveries will be made only to the addresses indicated on this site, validate your order after checking it, make the payment under the conditions set out below, confirm their order and payment.
The confirmation of the order implies acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions. All the data provided and the confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. This site will send confirmation of the order recorded by e-mail.
Article 8
WITHDRAWAL AND RETURN
The consumer has a period of 14 days to retract without having to justify reasons or pay penalties from the day of receipt of the goods. The goods must be returned in their initial state. The seller reimburses the buyer as soon as possible and at the latest within 30 days of the date of withdrawal. The return costs are the responsibility of the buyer, whatever the amount of the order. The return can be made on all or part of the order under the conditions stipulated above. The refund of the returned goods (s) will be made according to the conditions described in article 10.

PAYMENT
Payment for purchases is made at the customer’s choice by credit card: Visa, MasterCard, Credit card and PayPal.
Article 10
REIMBURSEMENT TERMS
Subject to compliance with its return conditions, BLACK ORCHID will reimburse returned items within 7 days of returning the goods to stock and at the latest within 30 days after withdrawal.
Article 11
DELIVERY OF GOODS
BLACK ORCHID undertakes to post your purchase within a maximum of 15 working days from the confirmation of payment.
Article 12
PERSONAL DATA
Personal information relating to buyers may be subject to automated processing. Users have the right to access and rectify data concerning them.
Article 13
SETTLEMENT OF DISPUTES
Only Spanish law is applicable in the event of a dispute over the intervention or the execution of these conditions and after the failure of any attempt to find an amicable solution.
